If you sell on Amazon.es or other Spanish marketplaces from Germany or another EU country, all mandatory product information must be in Spanish, and packaging and electrical goods need a Spanish authorised representative and a registration number. Spain also has its own packaging marking rules and a three-year legal guarantee. Here is what applies to a seller shipping from abroad, with the article behind each rule.
Spanish for everything the law requires
Spain’s consumer law (Real Decreto Legislativo 1/2007, TRLGDCU) requires the mandatory labelling and presentation information of goods sold in Spain to appear at least in Castilian Spanish (Article 18(3)). For distance contracts, the pre-contractual information — main characteristics, total price, who you are, the right of withdrawal, a reminder of the legal guarantee — must also be given at least in Spanish (Article 98(1)). If your shop or listing is aimed at Spanish consumers, Spanish consumer law applies even though your company is in Germany (Article 6 of the Rome I Regulation).
In a listing this means Spanish for:
- the product name and the characteristics a buyer decides on,
- the fibre composition of textiles (see below),
- warnings and safety information required under Article 19(d) of the GPSR,
- the guarantee statement and any conditions you advertise.
Catalan, Basque or Galician can be added, but they do not replace Spanish. A raw machine translation of a German listing is a common source of wrong terms — see machine translation of listings.
Packaging: registration and an authorised representative
Real Decreto 1055/2022 on packaging makes the productor de producto responsible: whoever packs products or imports or acquires packaged products from another EU country to place them on the Spanish market (Article 2(t)). For distance sales, the seller responsible for the sale counts as the packer of the packaging used for that sale (Article 2(e)).
A producer established in another Member State that sells products in Spain must appoint an authorised representative in Spain (Article 17(2)). The representative registers the producer in the packaging section of the Registro de Productores de Producto (Article 15), joins an EPR scheme, reports the packaging placed on the market every year by 31 March (Article 16(2)) and receives a registration number that must appear on invoices and other documents of the sale (Article 15(3)).
| Your situation | Who is the producer |
|---|---|
| Own-brand goods you pack in Germany and sell to Spain | You: appoint a Spanish authorised representative |
| Branded goods packed by a German manufacturer, resold by you | The manufacturer as packer, according to MITECO’s guidance; ask for its Spanish registration number |
| No representative appointed, goods sold through a marketplace | The marketplace, as a fallback for financial and reporting duties (Article 2(t)) |
| Shipping boxes for orders placed through a marketplace | The marketplace fulfils the financial and reporting duties on the producers’ behalf (Article 17(5)) |
Amazon announced in 2023 that sellers not established in Spain must give it a Spanish registration number for each EPR category (packaging, electrical equipment, batteries); otherwise Amazon declares and pays the eco-contributions for sales on Amazon.es and charges you a fee (“Pay on Behalf”). Your other producer duties remain yours. Check the current terms in Seller Central.
On top of this, the EU Packaging Regulation (EU) 2025/40 has applied since 12 August 2026: a producer that sells packaged products directly to end users in another Member State must appoint an authorised representative for EPR there by written mandate (Article 45(3)), and online marketplaces must collect producers’ registration numbers before letting them sell to consumers (Article 45(4)). The Commission proposed in December 2025 to suspend this representative obligation until 1 January 2035 (COM(2025) 982), and a parallel proposal does the same for electrical equipment (COM(2025) 983); by mid-October 2026 neither had been adopted. The Spanish rule in Article 17(2) of Real Decreto 1055/2022 is national law and would not be affected by the packaging proposal.
Packaging marking since 1 January 2025
Article 13 of Real Decreto 1055/2022 has applied since 1 January 2025 (fifth final provision):
- household packaging must state the fraction or bin it goes in; for packaging that cannot be separated easily, the bin of the predominant material by weight (Article 13(2)),
- reusable packaging must say so and carry the deposit-return symbol where one applies (Article 13(2)),
- packaging must not be marked “respetuoso con el medio ambiente” or any equivalent that could encourage littering (Article 13(3)),
- a percentage of recyclability only after an audited assessment by a third party, and a percentage of recycled content only with documentation (Article 13(4) and (6)),
- compostable plastic packaging must name the standard (UNE EN 13432) and, when compostable, say “no abandonar en el entorno” (Article 13(5)).
Generic environmental claims in listings are also banned by Directive (EU) 2024/825, which all member states had to apply from 27 September 2026. Germany and Italy apply it from that date; Spain had not transposed it as of October 2026 — the draft Ley de Consumo Sostenible is meant to do so. Even so, an environmental claim you cannot prove can already be misleading under Article 5 of Spain’s Unfair Competition Act (Ley 3/1991) (green claims ban). What you can still write:
| Instead of | Write |
|---|---|
| embalaje respetuoso con el medio ambiente | caja de cartón 100 % reciclado (only with documentation) |
| envase 100 % reciclable | leave it out unless you have an audited percentage |
| camiseta ecológica | camiseta de algodón orgánico con certificado GOTS |
The EU’s harmonised sorting label under the Packaging Regulation applies from 12 August 2028 at the earliest (Article 12(1)); until then, the Spanish rules above apply.
Electrical equipment and batteries
Under Real Decreto 110/2015 on WEEE (RAEE), a seller established in another Member State that sells electrical or electronic equipment by distance means directly to households in Spain is a producer (Article 3(h), point 4) and must appoint an authorised representative in Spain by written power of attorney (Article 3(j)). What follows:
- registration in the producers’ section of the Registro Integrado Industrial (RII-AEE), which assigns a producer identification number (Article 8),
- for distance sales: the number on the page that supports the sale and on the invoice to the buyer (Article 9),
- the crossed-out wheelie bin on every device (Article 7(1)),
- Spanish distributors may only sell equipment from registered producers (Article 11(1)).
Batteries, including those built into devices, have their own registration: since 18 August 2025, the EU Battery Regulation requires producers to register in each Member State where they first make batteries available (Regulation (EU) 2023/1542, Article 55). A draft royal decree to replace Spain’s battery decree (Real Decreto 106/2008) was out for consultation in summer 2026; check the current registration route before your first shipment.
Textiles: Spanish fibre names, EPR still in draft
The fibre composition must be visible before purchase, also online, and in the official language of the country where you sell (Regulation (EU) No 1007/2011, Article 16(1) and (3)). Use the Spanish names from Annex I:
| German | Spanish (Annex I) |
|---|---|
| Baumwolle | algodón |
| Polyester | poliéster |
| Elasthan | elastano |
| Viskose | viscosa |
| Polyamid | poliamida o nailon |
| Leinen | lino |
| Wolle | lana |
| Polyacryl | acrílico |
Example: “Composición: 95 % algodón, 5 % elastano”. More rules in textile fibre names.
Textile EPR: Ley 7/2022 provided for an EPR scheme for textiles, and MITECO consulted on a draft royal decree on textile and footwear products from 1 July to 4 September 2025. We found no final text in the BOE by October 2026, so there is no Spanish textile registration duty yet that we could confirm. Check the BOE before you plan for it.
Guarantee: three years, not two
German texts often promise “2 Jahre Gewährleistung”. In Spain the seller is liable for a lack of conformity that appears within three years of delivery (TRLGDCU Article 120(1), for goods sold since 1 January 2022); for second-hand goods you may agree on at least one year. A defect that appears within two years is presumed to have existed at delivery (Article 121(1)).
A commercial guarantee binds you as advertised, and its statement must be given on a durable medium, at least in Spanish, by the time of delivery (Article 127).
| Instead of | Write |
|---|---|
| 2 años de garantía | garantía legal de 3 años |
| garantía de 5 años | garantía comercial de 5 años, plus the conditions and how to claim it |
Checklist and listing check
- listing, warnings and guarantee in Spanish,
- packaging registration number in Spain (yours via an authorised representative, or your manufacturer’s),
- RII-AEE number on the product page and invoice for electrical goods,
- battery registration for Spain where batteries are included,
- packaging marked with the bin; no “respetuoso con el medio ambiente”,
- Spanish fibre names with percentages,
- “garantía legal de 3 años” instead of two.
The free listing check finds banned environmental claims such as “respetuoso con el medio ambiente” or “sostenible” and CE wording like “certificado CE” in Spanish text, and checks title and keyword limits. For a single phrase, use the claims checker; for the manufacturer and safety block, the GPSR generator.
